Data protection for driving schools
The processing of personal data also plays an important role in driving schools. Although the "core activity" may not seem particularly relevant from a data protection perspective at first, a closer look reveals various pitfalls: the website, which must be designed in a data protection-compliant manner, the performance of examinations and tests, contractual data, and even health data (eye tests). A close examination of data protection issues is therefore important.

Do I need a data protection officer?
Required by law
You are obligated to appoint a data protection officer if you employ at least 20 persons on a permanent basis for the automated processing of personal data (Section 38 (1) BDSG). The hurdle as to when an employee is "constantly" involved in the processing of personal data is low: the regular processing of e-mails or other electronically/systematically recorded data is sufficient.
Voluntarily
You can also appoint a data protection officer voluntarily. This has several advantages: you avoid cost risks from warnings, claims for damages or fines, you have a fixed contact person if a problem does arise, and you can react quickly. The latter is particularly important, as the GDPR sometimes sets very tight deadlines. For example, a data protection breach (e.g., a hacked email inbox) must be reported to the supervisory authority within 72 hours if it poses a risk to data subjects (Art. 33 GDPR). If you do not seek help until then, it is usually already too late...
